1. General

The information, tools, templates, and features provided through the HSES Online platform (www.hses.app) are provided by HSES Online for general information and management purposes only. While we endeavour to maintain a reliable and useful platform, we make no representations or warranties of any kind, express or implied, about the completeness, accuracy, reliability, suitability, or availability of the Platform or its content.

2. Not Professional WHS or Legal Advice

Nothing in the HSES Online platform, including any templates, forms, risk matrices, checklists, suggested actions, or written content, constitutes professional work health and safety (WHS) advice, legal advice, or regulatory compliance advice.

The Platform is a digital record-keeping and management tool. It does not assess the adequacy of your organisation’s WHS practices, policies, or systems, nor does it constitute an audit, inspection, or compliance review.

You should always consult a qualified WHS professional, safety consultant, or legal adviser for guidance specific to your circumstances and jurisdiction.

3. No Guarantee of Regulatory Compliance

Use of the HSES Online platform does not guarantee that your organisation is compliant with the Work Health and Safety Act 2011 (Cth) or any equivalent state or territory legislation, nor with any other applicable Australian or international health and safety regulation, standard, or code of practice.

Compliance with WHS legislation is the sole responsibility of the person conducting a business or undertaking (PCBU) and its officers, as defined under applicable law. HSES Online accepts no responsibility for any regulatory non-compliance, prosecution, penalty, or enforcement action arising from your organisation’s WHS practices, whether or not the Platform was used in connection with those practices.

4. Accuracy of User-Entered Information

The HSES Online platform relies on information entered by users of each organisation’s account. We do not verify, validate, or audit the accuracy, completeness, or currency of any information entered by users. We accept no responsibility for decisions made or actions taken based on inaccurate, incomplete, or misleading information entered into the Platform by users.

Users are responsible for ensuring that all information entered into the Platform is accurate, up to date, and recorded in a timely manner.

5. No Guarantee Against Incidents

Use of the HSES Online platform does not prevent workplace incidents, injuries, illnesses, or fatalities from occurring. The Platform is a tool to assist in managing and recording safety information; it is not a safety control or a substitute for effective hazard elimination, risk controls, training, supervision, or other operational safety measures.

6. Third-Party Links and Content

The Platform may contain links to third-party websites, resources, or services for your convenience. These links do not constitute an endorsement or recommendation of those third-party websites or their content.
